Information Cessantia Calculation
The Cessantia Act, details the rules concerning an obligatory minimal one-time payment to the employee, in case of a dismissal through no fault of his/her own.
The Cessantia is calculated as follows:
- The average gross monthly salary, which includes all fixed components such as holiday allowance, 13th month, etc;
- The first and up to and including the tenth full year of service, one (1) weeks wages for each year of service;
- The eleventh and up to and including the twentieth full year of service, one and a quarter (1¼) weeks wages for each year of service;
- The subsequent years of service, two (2) weeks wages for each year of service;
- A period of more than six months after the first year of service shall count as a full year of service.
